5. Verzugszinsen:

Verzugszinsen auf den rückständigen Mietzins können die Kläger lediglich in nicht mit der Berufung angegriffener Höhe von 7,5 % verlangen. Soweit ihnen nach dem Mietvertrag Zinsen in Höhe von 5 %- über dem jeweiligen Diskontsatz der Deutschen Bundesbank zustehen, verstößt die Zinsklausel gegen § 1 1 Nr. 5 AGBG, weil sie den höheren Zinssatz bereits bei Zahlungsrückstand des Mieters ab Fälligkeit ohne Rücksicht darauf gewährt, ob sich der Mieter auch in Verzug befindet.

Ein Verzugsschaden von 9,5 % ist hinsichtlich der in dieser Höhe behaupteten Inanspruchnahme von Fremdmittel nicht bewiesen. Ein Beweisantritt fehlt. Die Kläger habe im übrigen auch ihrer Anschlussberufung lediglich einen Zinssatz von 7,5% zugrunde gelegt.

Die Berufung hat daher in Höhe des 7,5 % übersteigenden Zinssatzes und hinsichtlich der Kaution hinsichtlich des 4 % übersteigenden Zinssatzes Erfolg.
